What is the minimum energy efficiency standard (MEES)?

The minimum energy efficiency standards (MEES) are regulations that, from April 1 2018, make it illegal for owners of commercial buildings in England and Wales to let properties which do not have an Energy Performance Certificate (EPC) rating of at least ‘E’.

The scheme, previously known as minimum energy performance standards (MEPS), will mean commercial landlords whose building is rated below ‘E’ on the EPC scale will have to make energy-efficiency improvements before granting new tenancies or renewing existing ones.

MEES does not apply to all commercial buildings, however. Exceptions include:

  • Industrial sites
  • Workshops
  • Non-residential agricultural buildings with a low energy demand
  • Some listed buildings

The penalty for non-compliance will be 10 and 20 per cent of the property’s rateable value for buildings rented out for up to three months and exceeding three months respectively. Fines range from £5,000 to £150,000.

This upcoming legislation puts pressure on landlords to improve their building’s energy efficiency or face being unable to let the property. Meanwhile, selling non-compliant building space will prove challenging, as interested buyers may be deterred by the prospect of carrying out upgrades in order to meet MEES.
