Why commercial landlords may need to take urgent action on their HVAC systems

The minimum energy efficiency standards (MEES) are regulations that, as of April 1st 2018, make it illegal for owners of commercial buildings in England and Wales to let properties which do not have an Energy Performance Certificate (EPC) rating of at least ‘E’.

The scheme, previously known as minimum energy performance standards (MEPS), means that commercial landlords whose building is rated below ‘E’ on the EPC scale now have to make energy-efficiency improvements before granting new tenancies or renewing existing ones.

MEES applies to most commercial buildings, with exceptions including; industrial sites, workshops, non-residential agricultural buildings with a low energy demand and certain listed buildings.

The penalty for non-compliance is 10% of the property’s rateable value for buildings rented out for up to three months (20% for those exceeding three months). Fines range from £5,000 to £150,000.

This new legislation means landlords are now under pressure to improve the energy efficiency of their building or face being unable to let the property. Selling non-compliant building space will also be problematic, as interested buyers may be deterred by the prospect of having to carry out significant upgrades in order to comply with MEES.
